    Thomas P. Hartzfeld Sr.:While researching another project I came across an interesting PA Supreme court decision that relates to methane gas. United States Steel Corporation v. Mary Jo Hoge etal from 1983. The Coal Company owned the coal and had the right to remove same,the "court has not construed the conveyance of coal alone as a grant of a fee simple estate in the situs where the coal is located.Rather, the coal owners interest in that situs has been regarded as being in the nature of an estate determinable, which reverts to the surface landowner by operation of law at some time subsequent to removal of the coal. (Webber v. Vogel)(Chartiers Block Coal Co. v.Mellon) The potential for reversion of the situs, however does not deminish the character of the coal as property of its grantee,or of the gas contained therein as a mineral 'ferae naturae' resting inside the coal owners property and falling within the dominion and control of the coal estate" In most cases the owner of the coal owns the coal and the right to remove the coal, if the coal company exercises those rights by deep mining and creates voids between the stumps and ribs left behind to hold up the roof(the open areas where coal was removed)it appears the court has ruled that the methane remaining in the coal(stumps, ribs, etc.) belongs to the coal company, but because of the fugacious nature of gas, the methane that migrates from the coal into the void created by the removal of the coal belongs to the landowner. Under a lease only from the coal company the drilling company would only be able to take gas from the coal, any drilling into the void would require a lease from the surface owner. Have you run into this situtation?
    cathy gramlich:I have been approached to sign a lease. You said no question is stupid i'm not sure, my husband was in woods sitting on a pile of rocks when all of a sudden this noise like an old tractor (antique he says)came out of the ground that was so foreful it blew leaves and dirt away, It was like a hugh burst of air like a guiser would shoot out could this have anything to do with underground gas or minerals and have you ever heard of this before!
    jennyski:I don't plan on leasing my land. I am, however very worried about the environmental impact not only with air quality but also my land and water supply. If I have my water tested now and it turns out ok, but later to find out, after my neighbors lands are drilled, that my water is contaminated, can I sue the oil company and/or my neighbors?
